Summons Admission Procedures and Application

After a case is registered, the summons or the application will be submitted to the defendant / respondent Party through the Process Server.

After the summons / application is accepted, the defendant / respondent Parties are required to attend court for mention. In today's terms, if the parties have agreed to settle the case, the agreement may be recorded and the case is completed.

If the parties do not consent, the defendant / the Respondent shall file a reply to the Statement of Claim / Application Affidavit. If the defendant / respondent Parties have made Counterclaim, the Claimant / Applicant shall file an answer to the counterclaim.

For cases of summons and after responses to the Statement of Claim and the answer to the counterclaim (if any) is filed, the parties are required to file a document that ties the relevant documents to be filed claims. After all the above procedures completed the parties will be given a hearing date. 

Any summons or application received by the defendant / the Respondent shall be filed responses to the Statement of Claim / Application Affidavit. If not filed responses to the Statement of Claim / Application Affidavit, court summons or application is considered approved by the defendant / respondent and the court may decide without trial if the defendant / respondent party fails to appear in court on the appointed day.

If the defendant / respondent Parties present at the trial, they have no right to give evidence and if the evidence is also the court will not record such information and such information will not be accepted.
