Registration Procedures of Faraid Case

Faraid is how to solve the problem of the division of an estate Muslims left after the occurrence of a death.

Estate is divided into two sections:

  • Immovable property such as land and houses;
  • Movable property such as vehicles, jewelery, shares, savings, EPF money, insurance money and etc.

Here is the guide of Registration Application for Certificate Faraid in Syariah Subordinate Courts in the State of Kedah Darul Aman.
Each application shall be completed by a certificate faraid the following items:

  • The application form must be duly completed. The applicant must be one of the heirs entitled to the estate.
  • Shall be submitted by the original death certificate (for authentication) and a copy of the death certificate of the heirs or testimonial oath of death.
  • Copy of identity card or birth certificate of the heirs that entitled to the property.
  • A copy of Form A (Issued by the District Land Office).
  • A copy of the property valuation report (issued by the District Land Office).
  • A copy of the document properties that can be removed and can not be removed. If the property is held by Amanah Raya Berhad, the application shall be accompanied by a letter from Amanah Raya Berhad, which stated the value of  the deceased's property values.
  • Registration fee for Faraid certificate will be charged in accordance with the values of the real-estate.

Once the application is registered the applicants will be given a date for the heirs investigation. The applicant should know the full facts regarding the composition of the deceased and the heirs of the deceased and the applicant shall present to the court together with two male witnesses for the heir investigation on the date and time specified.
